Terms of Service

These terms cover your use of Texted You Back ("the service", "we", "us"), the missed-call text-back service at textedyouback.com. By creating an account or using the service, you agree to them. If you don't agree, don't use the service.
1. What the service does
When a call to a participating business goes unanswered, the service sends the caller a text message on that business's behalf, notifies the business, and relays replies between the business and the caller. The business ("you", the account holder) decides the message content, business hours and settings.
2. Your account
- You must give accurate information and keep your password private. You're responsible for activity under your account.
- You must be authorized to act for the business you sign up, and able to form a binding contract.
- We may approve, pause or close accounts, for example for misuse or non-payment.
3. Your responsibilities for texting
You are the sender of the messages sent for your business, and you are responsible for following the laws and carrier rules that apply to them, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines and carrier registration requirements. In particular, you agree that:
- Automatic texts are sent only in response to a person calling your business, about their inquiry.
- You won't use the service for marketing, promotions or bulk messages, or to text anyone who hasn't contacted you.
- Your messages identify your business and include opt-out instructions (the service adds "Reply STOP to opt out" automatically), and you honor opt-outs.
- You won't send unlawful, misleading, harassing or harmful content.
4. No guarantees
The service is provided "as is" and "as available". Text delivery depends on phone carriers and other providers outside our control, and messages can be delayed, filtered or not delivered. We don't guarantee any particular result, such as a number of calls caught, replies or jobs won. Figures on our website, including the cost calculator, are illustrations based on numbers you enter, not promises.
5. Free trial, fees and cancellation
- New accounts can try the service free for the first month. We'll tell you the price and get your agreement before any charge.
- Paid plans are billed monthly at the price shown when you subscribe. There's no long-term contract: you can cancel anytime, effective at the end of the current billing month.
- Missed-call texts and replies are included in your plan, subject to fair-use limits that protect the service (for example, a daily cap on texts per business). We'll contact you before applying limits to normal use.
- Founding offer: while offered, the first 10 businesses to start a paid plan pay $49/month. That price stays the same for as long as their subscription remains active without a break; it ends if the subscription is cancelled.
- Prices may change with at least 30 days' notice. Founding prices are not increased while the subscription stays active.
6. Your data
How we handle information is described in our Privacy Policy. You give us permission to process your business information, and the phone numbers and messages of people who contact your business, only to run the service for you.
7. Acceptable use
Don't misuse the service: no attempts to break in, overload it, reverse-engineer it, or use it to break the law or anyone's rights. We may suspend accounts that put the service, carriers or other customers at risk.
8. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or business opportunities. Our total liability for any claim is limited to the amount you paid us for the service in the 3 months before the claim.
9. Indemnity
You agree to cover claims, fines and costs that arise from the messages you send through the service or your breach of these terms, including claims under texting laws.
10. Changes and ending the service
We may update these terms. If a change is significant, we'll let account holders know before it takes effect. Continuing to use the service after that means you accept the new terms. You can stop using the service at any time.
